Statement of the Prosecutor’s Office in Relation to Annulling Interpol Red Notice, International Search warrant against Z. Adeishvili

On January 10, 2013, Office of the Chief Prosecutor of Georgia filed a request before the General Secretariat of Interpol on announcing international search via Red Notice against Zurab Adeishvili. In the process of considering the issue, General Secretariat of Interpol has requested additional information on several occasions regarding criminal cases proceeded against Z. Adeishvili from the Office of the Chief Prosecutor of Georgia. Georgian party comprehensively provided all necessary documentation to the General Secretariat of INTERPOL in due time. Based on the materials provided by the Office of the Chief Prosecutor of Georgia, the General Secretariat of Interpol considered that announcement of international search via Red Notice Application against Z. Adeishvili was in full compliance with the Constitution of Interpol and correspondingly, on November 14, 2013, international search via Red Notice Application was announced against the above mentioned person.
On April 9, 2015 Office of the Chief Prosecutor of Georgia received a letter from the General Secretariat of Interpol informing the Georgian Party that the General Secretariat of Interpol has annulled the Red Notice Application issued against Zurab Adeishvili. General Secretariat of Interpol referred to the fact of granting the refugee status to Z. Adeishvili by one of the states, which is unknown to the Georgian party, as to the main ground for annulling the international search of Z. Adeishvili.
It is worth mentioning that the General Secretariat of Interpol has made a decision regarding annulling international search against Z. Adeishvili without requesting additional argumentation or submission of relevant documentation from the Georgian Party and the latter became aware of the mentioned fact only after the Red Notice Application against the fugitive was annulled. Correspondingly, in the process of considering the matter, Office of the Chief Prosecutor of Georgia lacked the capacity to present its additional argumentation regarding the reasonability of continuing the search against Z. Adeishvili to the General Secretariat of Interpol.
In the nearest period, Office of the Chief Prosecutor of Georgia plans to carry out relevant procedures foreseen by the legislation in relation to the mentioned issue.
