Investigators of especially important cases of the Division of Criminal Prosecution of Corruption crimes of the Office of Prosecutor General of Georgia are inquiring of Ivane Merabisvhili at the 9th penitentiary facility in the presence of his attorney.
The inquiry will be conducted based on Ivane Merabishvili's attorney's request. On March 21, 2019, the Attorney filed a written motion to the Office of Prosecutor General of Georgia and requested as one of the demands to interview Ivane Merabishvili and to take steps to determine whether he can identify persons.
In relation to persons’ identification issues, Ivane Merabishvili was interviewed by the employees of the Ministry of Corrections of Georgia on January 3, 2014, and on June 24, 2016 he was interrogated as a witness to the criminal case. In both cases Ivane Merabishvili stated he could not list the visual characteristics of the persons involved in his taking from the penitentiary facility. According to the Criminal Procedure Code of Georgia, recognition procedure is not conducted, and it is inadmissible evidence, if the identifier indicates those characteristics not enough to identify the object. Thus, in both cases, it was impossible to conduct recognition procedure.
We would like to remind you that after taking the decision by the European Court of Human Rights, on 12 July 2018, there was renewed investigation of this criminal case and it was handed over to Division of Criminal Prosecution of Corruption crimes of the Office of Prosecutor General of Georgia.
