Batumi city court upheld evidences produced by prosecution and found three persons supporting “criminal underworld“ and one person for being so called “thief in law” and participation in “criminal gathering“ guilty.
Evidences investigated during trial confirmed that so called “thief in law” M.L. by “criminal gathering”, committing crimes, encouragment to commit crimes, using his own criminal authority and other illegal activities to receive profit for him as well as for others, obtain power, by electronic communication, in different regions of Georgia, including Batumi, used to lead members of “criminal underworld” that was also supported by I.G. Sh.K. and Z.A. in April-June 2018, that created real, direct and substantial threat to carry out activities of “criminal underground”.
Law Enforcement Bodies arrested I.G on July 17, 2018, as for Sh.K and Z.A. they were arrested on July 18, 2018. They were accused under Article 2231§1 (membership of criminal underworld) and Article 2232 (participation in criminal gathering) of Criminal Code of Georgia. Since M.L is in hiding, without his presence he was accused under Article 2231§2 (thief in law) and Article 2232 (participation in criminal gathering) of Criminal Code of Georgia. All of them were sentenced to detention as a measure of constraint. As for M.L there has been declared search.
Batumi City Court found I.G., SH. K. and Z.A guilty under Article 2233§1 (supporting criminal underworld) and M.L. under Article 2231§2 (thief in Law) and Article 2232 (participation in criminal gathering) of Criminal Code of Georgia.
Based on Court’s decision, I.G was sentenced to 2 years and 6 months in prison, Sh.K and Z.A. to 2-2 years in prison, as for M.L. he was sentenced to 10 years in prison. After receiving argumented judgement, prosecution will discuss the issue of appeal of decision in part of change of qualification.
