Prosecutor's Office has filed a charge against T.B. on fact of violence toward former spouse and false denunciation within the investigation carried out by the Ministry of Internal Affairs.
The investigation established that on February 2, 2018, at about 19:30, T.B. with her mother - L.Kh came to the house of her former spouse N.K. for taking a child. Since the child did not want to go and started crying, N.K. had argue with T.B. at the entrance of house, during which B.T. has hit hand to N.K in his face and body area in several times, in presence of minor child, after this she inflicted injuries with fingernails in the form of scratches, notches and bruises, and as a result, the victim suffered physical pain. In order to avoid further conflict, N.K entered the house and closed the doors. Offended with happened fact, with purpose of revenge toward former spouse, T.B. has called to police and made a false denunciation, as if she was beaten by former spouse. She also pointed N.K. as a criminal offender to police officers arriving at site, whereby N.K. was detained on the spot.
With the evidences obtained on the case, including the video recordings depicting the case, guilt of N.K. was not confirmed, he was released from the temporary detention isolator and according to Prosecutor's Decree criminal proceedings against him was stopped, and T.B. was charged according to the first part (false denunciation of N.K. – on committing a crime) of Article 373 and subparagraph “b” (violence by one family member of another family member, which has resulted in physical pain in the presence of the minor) of second part of Article 1261, which is confirmed by video recording depicting the case, with forensic medical expertise conclusions, and testimonies of victim and other neutral witnesses.
The Prosecutor's Office of Georgia has already appealed to the court with the motion of the bail for the defendant as a preventive measure.
Investigation is underway on criminal case. The accusation for the defendant is foreseen a penalty, a public servant or four years of imprisonment.
