Batumi City Court has fully accepted the evidence, submitted by the prosecution and found guilty defendant E.H. accused of domestic violence and intentional damage to family member’s property under the 1st paragraph of Article 1261 (two episodes) and 111, and the 1st paragraph of Article 187 of Criminal Code of Georgia.
According to the evidence submitted to the Court, it was established that on 3 January 2018, in the daytime, in the apartment in Kobuleti, H.M. physically insulted his spouse M.D., and intentionally damaged the TV, windows, and mirror owned by the victim’s father A.D. Due to the actions of E.H., M.D. experienced physical pain, and A.D. suffered considerable damages.
Also, it was determined, that on 22 August 2017, in the evening time, in Kobuleti, E.H. physically insulted his spouse, and as a result, she experienced physical pain.
Law enforcers detained E.H. on 6 January 2018, in Kobuleti. The E.H. has been charged under the first paragraph of Article 1261 (violence by one family member against another family member, which has resulted in physical pain) and 111, and the first paragraph of Article 187 (intentional damage of the object) of Criminal Code of Georgia.
Batumi City Court found E.H. guilty of accusation and determined the type and the length of the sentence to 8 months of imprisonment as a result of cumulative crimes, from which the 4 months he will spend in a penitentiary facility, while 4 months were considered conditional with 2 years’ probationary period.
