Tbilisi City Court has fully accepted the evidence, submitted by the prosecution and found guilty the defendant R.A. for the attempt of sexual assault and for the intentional murder with the aggravating circumstance under the 1st paragraphs of the Articles 19 and 137, the subparagraph “d” of the 1st paragraph and the subparagraph “b” of the 3rd paragraph of the Article 109 of Criminal Code of Georgia.
According to the evidence, examined by the court, it was established that on 16 July 2018, in Tbilisi, R.A. attempted to sexually assault his cousin A.Kh. by threatening and using a force, however, he failed to commit the assault because of the resistance of the A.K. In order to cover up the crime, with intention to inflict the serious suffering and pain, R.A. stabbed the A.Kh. several times with the extreme cruelty and left the crime scene. As a result of received wounds the A.Kh. passed away.
Law enforcers detained R.A. on 18 July 2017, in Poti. He has been charged under the 1st paragraphs of the Articles 19 and 137 (attempt of sexual assault), the subparagraph “d” of the 1st paragraph (murder aimed at concealing other crime) and the subparagraph “b” of the 3rd paragraph (murder with the extreme cruelty) of the Article 109 of Criminal Code of Georgia and remanded to imprisonment as a preventive measure.
Tbilisi City Court found R.A. guilty of accusation and determined the type and the length of the sentence to 18 years of imprisonment.
