Criminal Prosecution Launched against Three Patrol Police Officers for Negligent Manslaughter and Exceeding Official Powers

As a result of the investigation conducted by the Prosecutor’s Office of Georgia, criminal proceedings have been launched against three patrol police officers for the facts of negligent manslaughter and exceeding official powers. Prosecutor’s Office indicted them under Article 116 §1 and Article 333 §2 of the Criminal Code of Georgia, and filed a motion with court requesting to impose GEL 5000 bail on each them and discharge them from their positions. Gori District Court imposed GEL 1000 bail on the accused and as a measure of constraint and decided to discharge them from their positions.
Investigation has established, that on May 17, 2017, with the aim to stop a BMW make X5 model vehicle driven by B.Kh. with excessive speed on Tbilisi-Senaki-Leselidze motorway, officers of Kareli Patrol Police Department of the Ministry of Internal Affairs, patrol inspectors Z.R., G.S. and N.Kh. exceeding their legal powers and blocked the road with vehicles of citizens at the Gori tunnel. Patrol inspectors were unreasonably hoping, that by such action tey would manage to stop the vehicle and communicate with the driver in the manner prescribed by the law, however, the driver was unable to avoid crash due to the artificial obstacles while coming out of the tunnel, took the first lane without using brakes, as a result whereof, crashed into a FORD TRANSIT 190 EF vehicle parked in the shoulder, than into a MERCEDES-BENZ ACTROS cargo truck parked on the motorway. B.Kh. died at site due to the injuries.
Investigation into the case is in progress under Article 116§1 (negligent manslaughter) and Article 333§1 (exceeding official powers) of the Criminal Code of Georgia, which entails deprivation of liberty for a term up to five years
