Responding Statement of the Prosecutor’s Office to the press center of Supreme Court of Georgia

Press-center of Supreme Court of Georgia announced false information that proves as if the documentations of advocate A. Aladashvili submitted for the investigation refer to other judge than the judge of Supreme Court of Georgia Besarion Alavidze.

In order to avoid disinformation of the public, Prosecutor’s Office decides to publish some of investigation details regarding the issue, particularly the fact that Aleko Aladashvili and a citizen Pridon Maisuradze conducted discussion at the court regarding the judge Besarion Alavidze’s diploma, who required to annul decision made by Besarion Alavidze based on the motivation that the judge Besarion Alavidze didn’t have a higher legal education. Supreme Court didn’t remedy a grievance and declared that this was not the ground for objection to the judge. Consequently, before Aleksandre Aladashvili filed an appeal at the Prosecutor’s Office judicial body should have been aware of the circumstances that Besarion Alavidze  didn’t hold any documentation confirming his higher legal education.
In the investigation part of the Main Prosecutor’s Office of Georgia based on the investigation commenced in accordance to the Aleksandre Aladashvili’s statement there was determined that the judge Besarion Alavidze has a document issued by Iv. Javakhishvili Tbilisi State University confirming completion of the faculty of “Arts and Humanitarian professions” which is a document confirming his higher education.
In order to deliver the right information to the public we publish the full version of the letter of Tbilisi State University as of February 28, 2013 which was requested by the investigation.

In response to your letter (# 13/20851, 21/02/2013) which entered Iv.Javakhishvili Tbilisi State University where you enquired whether there the diplomas (Diploma E #002350 and Diploma E #001507) issued on behalf of Besarion Alavidze and Maia Gigauri by the faculty of Humanitarian Professions of the University are the documents confirming of the legal education or not, we hereby inform you that:
1.    The faculty of”Art and Humanitarian Professions” of Iv. Javakhishvili Tbilisi State University gives opportunity to students and any interested people to master common humanitarian education along with the specialty recieved at the relevant faculty. It doesn’t consider award of any qualification and/or degree. At Iv. Javakhishvili Tbilisi State University the faculty of secondary professions were created in 1965 and held different name in different time (Order # 7, 31.01.1991). Program of Law at the mentioned secondary faculty was scheduled for three academic years and after its accomplishment a dean of faculty used to issue an Order regarding the issuance of a diploma for the students who accomplished the mentioned educational program.  For this category of students the special form of diploma were issued (other than the form established for the students of any stage of the University academic education and approved by the state) without granting an academic degree and qualification.
2.    Diplomas issued for the students who graduated from Tbilisi State University – faculty of Art and Humanitarian Professions showed dates for entrance and finish the relevant faculty and indicated the relevant specialty but did not award any academic degree or qualification.
3.    In order to avoid any misunderstanding arose from the documents issued by the faculty of Art and Humanitarian Professions, Iv. Javakhishvili Tbilisi State University issued the Order # 68/01-01 about regulation the question regarding the award of academic certifications and certificates which defined that the certificate had to be awarded to the students who graduated from the faculty of Art and Humanitarian Professions.
4.    According to the Orders issued by the faculty of Art and Humanitarian Professions at Iv. Javakhishvili Tbilisi State University in 1998 and 2002 (Order # 20/291 as of 12.07.2002 and # 1/061 as of 27.10.1998 issued by the Dean of the faculty of Art and Humanitarian Professions at TSU) Maia Gigauri and Besarion Alavidze were not awarded any academic degree or qualification.
In accordance with the above mentioned the faculty of Art and Humanitarian Professions of Iv. Javakhishvili Tbilisi State University didn’t award Maia Gigauri and Besarion Alavidze lawyer’s qualification and diplomas issued on their behalf (Diploma E #002350 and Diploma E #001507) are not the documents confirming the higher education.
