Statement of Main Prosecutor’s Office

 On 8th January, 2013, the Main Prosecutor’s Office of Georgia sent the copies of criminal law materials to the Service of Financial Monitoring of Political Parties’ State Audit Service.

 It is known for the public that on 8th September, 2012, “The United National Movement” held congresses in the 11 cities of Georgia.
The General Secretary of the party Mikheil Machavariani, hired the companies of “the yellow micro buses to transfer people to Zugdidi, with appropriate treaty. 39 900 GEL was transferred from the account of the party, which was only the labor compensate of the drivers. Due to the fact that a great number of fuel was needed for micro buses, the assumed scheme was made by the activity of “Black Channel” to finance it. The Ministry of Internal Affairs of Georgia was involved in this scheme.
 It is stated by the investigation, that for the fighting against criminal and protecting public order, from the fuel targeted having bought from the budget, with the arranging of that time’s undersecretary- Nikoloz Dzimtseishvili and the Head of the Department of Constitutional Security – Levan Kardava, 54 000 liter talons were given to the representative, Aleksandre Kobalia, the governor of Zugdidi Municipality.  Kobalia redistributed these illegally received fuel talons to the 393 drivers of micro bus.
 It is stated also by the investigation that on 23rd September, 2012, for organizing the action of “The United National Movement”, in Zugdidi, the requested expenses 120 000 GEL, secretly, without any fixation in the Financial Declaration, was paid by the Deputy of Tbilisi Mayor, Davit Alavidze,  and made an illegal donation in favor of the party. Because in the process of investigation the possible outrage of the law about “ The Political Unification of People” was identified, for studying and  further reaction  the materials were sent to the Service of Financial Monitoring of the Parties, on the following facts:
 1. The 54 tone petrol talons transferred to “The United National Movement” by N. Dzimtseishvili, on 6th September, 2012, which cost 126.900 GEL, may be detected as an illegal donation.
2. The cash 120. 000 given to the company of “ micro buses of Tbilisi” by “ The United National Movement” on 22nd September, 2012, may also be detected as an illegal donation.
3.  The cash 56. 000 given to the company of “ micro buses of Tbilisi” by “ The United National Movement” on 28th September, 2012, may also be detected as an illegal donation.
Everything afore-named may be considered as an illegal donation because the legal person does not have the right to donate, but the private person has the right to donate up to 60. 000 GEL ( The Organic Law of Georgia: “ About the Political Unification of Citizens”, chapter III, Articles 26 and 27 “E”).
